Industrial licensing-updates
In the new Responsible Industry System (SIR) which came into force on 1 of June 2015 (73 DL/2015), were laid down new rules for industrial licensing. But what exactly is the industrial licensing? Installation, modification and operation of industrial plants are subject to industrial licensing. It is a legal obligation in which it intends to prevent risks associated with the operation of these units and promote the health and safety of persons and property, the quality of the environment, among other aspects. The licensing process is managed by a coordinating entity, depending on the classification of economic activity of the applicant company, which requests a view to entities with responsibilities in the areas of the environment, hygiene, and safety and health at work. The Authority for Working Conditions (ACT) integrates this process by participating in joint surveys with the licensor and other participating entities. What are the most relevant changes? - Creation, for all industrial plants, of a digital title of installation/operation that certifies "that are issued all licenses, permits, opinions or any other permissive or non-permissive acts, or made all the communications necessary for the installation and/or operation of the industrial establishment (DL 73/2015). This title should be requested at the Kiosk of the Entrepreneur; - Definition of a single rate and fixed value per procedure; - Change in the classification criteria of industrial establishments, leaving the parameters "number of workers", "electric power" and "thermal power" and adopting as classification criteria the 3 types of industries (classified according to the degree of danger) and in two categories: establishments that require prior inspection and establishments that doesn’t require prior inspection to the beginning of exploration; - Only Type 1 industries are required to have a prior inspection to the attribution of a digital title of installation and another of exploration. For the Type 2 industries is also required a permit or an opinion to the management operations of waste but without prior inspection; - Extinction of the licensing requirement for the industries that comprise the Type 3, which shall be subject to a system of merely prior notification and may start the respective exploration immediately after such communication.
